Terms and conditions for all the activities and rental equipments provided by Kilpissafarit LP

Activities
The following terms apply to all activities and services sold and provided by Kilpissafarit Oy.
1. Services and booking conditions
The prices and descriptions of the programmes and services offered by Kilpissafarit Oy are descripted in product cards. Prices include value added tax. Kilpissafarit reserves the right to price adjustments, for example, in case of changes in Vat percentage.
Tours require minimum number of customers to run. If less customers, Kilpissafarit will contact customers latest on previous day and provide options of either cancellation with full refund or option for private tour with extra cost. Customers can request from Kilpissafarit about current status of booking by e-mail: info@kilpissafarit.fi
1.1 Booking
The booking is binding regardless of whether it is verbal agreement or in writing (Kilpissafarit web shop or e-mail). The booking is confirmed when the reservation is paid, unless otherwise agreed in writing or by email.
1.2 Cancellation
The cancellation must be sent in writing to info@kilpissafarit.fi including the name of the customer, the date of the booking and the product identification. Kilpissafaris confirms cancellations by e-mail.
1.3 Cancellation policy
• Refund 100 % of payment if cancellation is made 7 days prior to start of the booked service
• No refund of payment if cancellation is made less than 7 days before the booked service
• Refund 100 % of payment If Kilpissafarit makes cancellation due to hazardous weather or other compelling reasons
1.4 Changes to the reservation
Changes concerning the confirmed booking must be sent in writing to info@kilpissafarit.fi including the name of the customer, the date of the booking and the product identification. Kilpissafaris confirms changes by e-mail according to our booking terms.
1.5 Language of service
Activities are guided in English and /or Finnish.
2. Customer responsibility
Customers is responsible for arriving to agreed meeting place at agreed meeting time. Meeting place is Kilpissafarit office unless pick up and return service is booked. If customer booked pick up and return service, the customer is responsible for arriving right pick up place 15 minutes before booking. Pick up time is 15-5 minutes before start of the activity. Kilpissafaris meeting address is Tsahkalluoktantie 14, 99490, Kilpisjärvi. It is easy to find Kilpissafarit by writing to google maps: Kilpissafarit. Meeting time is 15-0 minutes before start of the activity. In particular, the time difference between Finland and Norway and Sweden must be taken into account.
Kilpissafarit is not responsible for accidents or damages caused by irresponsibility or negligence on the part of the customer. The customer must follow guides´ instructions during activities. Kilpissafarit is entitled to charge the costs caused by customer´s negligence.
Some of the activities offered by Kilpissafarit are physically challenging. Pregnant and physically disabled customers participate in the programme at their own risk. If health issues require special arrangements (for example additional transport), Kilpissafarit will not cover additional costs.
Kilpissafarit reserves the right to utilize photos and video material recorded during the activities without a separate permission. Kilpissafarit can use photos and video material in their publications or in social media. If customer doesn´t want to appear in any recordings he/she must notify us at info@kilpissafarit.fi in advance by attaching a recognizable image for identification. The image is handled confidentially and only for identification purposes.
Customer exempts Kilpissafarit LP, its staff and employees from any damage and accident resulting from customer negligence and violation of these terms and conditions.
3. Kilpissafarit Lp’s responsibility
Kilpissafaris always carries out damage and accident prevention, contingency planning, lawfulness, and safety regulations in accordance with Finnish law and industry standards. Kilpissafarit is not responsible for insurmountable or unexpected situations. These include, for example, natural disasters, hazardous weather conditions, transmissible diseases and epidemics, strikes, etc. Kilpissafarit is responsible for informing customers and for minimizing any inconvenience.
Kilpissafarit reserves the right to change routing or content of activities depending on weather conditions or customer comfort. Kilpissafarit LP reserves the right to suspend any activity if the customer poses a risk to himself or to others.
Kilpissafarit LP is liable for personal injuries which occur during the scheduled programs and are caused by the negligence of Kilpissafarit staff. Kilpissafarit is not liable for accidents or damages covered by personal travel insurance.
4. Insurance
Kilpissafarit LP liability insurance covers personal and property damage. The insurance company is A-Vakuutus Oy.
Traffic insurance (motor vehicles) covers personal injuries and damages to the other party. In the case of an accident, injured person will receive medical care according to Finnish traffic Insurance Act. The insurance does not cover any damage caused intentionally or negligently. Customers are liable for damages caused to snowmobiles. The maximum liability is € 1,000 per damage. Snowmobile driver must be at least 15 years of age and present an applicable driver’s license. Finnish law prohibits driving snowmobile under influence. Kilpissafarit recommends customers to obtain personal travel insurance.
5. Force Majeure
Both parties are released from their responsibilities in Force majeure cases, such as weather conditions, lack of snow or natural disasters. In case of Force Majeure, both parties must inform each other as soon as possible and keep each other up to date as the situation progresses. The parties must act to minimize the inconveniences caused by Force Majeure situations.
6. Applicable law
Our terms and conditions are in accordance with Finnish law and jurisdiction. Disputes are primarily settled through negotiation. If disagreements are brought to court, a lawsuit must be filed at the nearest district court (Lapin Käräjäoikeus).
Snowmobiles

Language of service

1. Renter agrees to comply with Finnish law and regulations and good manners. It is forbidden to use snowmobile for any kind of racing, competitions, drive on roads or other illegal action. Forwarding the snowmobile to a third party is not allowed without permission from Kilpissafarit. Driving on terrain off the trail is prohibited by Finnish law. Speed limit on terrain 60 km/h and on lake 80 km/h. Kilpissafarit reserves the right to cancel this agreement if the renter violates this agreement or the renter is not following proper use and care of the snowmobile. In that case the rental fee is not reimbursed.
2. Driver must be at least 15 years old. Driving under influence of alcohol or drugs is prohibited.
3. Snowmobiles are equipped with Green Key, which limits engine power to eco-mode and top speed between 50-70km/h depending on conditions. Rent includes 150 km/day, the excess kilometres will be charged 2 €/km, unless otherwise agreed in the offer.
4. Rent does not include clothing, fuel or lubricants. The snowmobile is rented with a full tank of fuel and will be filled up again at the end of the rental at Kilpissafarit. If the renter refills the tank elsewhere, only 98 E-5 fuel must be used.
5. During the rental period renter is responsible for normal snowmobile costs and maintenance, like checking fluid levels and replacement of variator belts.
6. Renter is responsible for all damages caused to snowmobile or to a third party.
7. Snowmobile breakdowns must be reported immediately to Kilpissafarit. Repair work is not allowed without permission from Kilpissafarit. In case of technical failure and Kilpissafarit repairs the vehicle or replaces it within reasonable time. There will be no extra refund given concerning rental time or price. In case of technical failure occurs in location of more than 30km from Kilpissafarit office, the customer is responsible for the costs of transporting the snowmobile to Kilpissafarit office for repair or replacement.
8. Before leaving the rental premises, renter must check the vehicle and report any possible problems.
9. Snowmobile must be returned in scheduled time and same condition, extra rent is charged by hourly rate / starting hour / snowmobile.
10. We provide free assistance by phone. On-site assistance if not related to technical failure will be charged minimum 50 € depending on location.
11. Disputes will be settled firstly through negotiation. If dispute goes to court, complaint must be appealed to the district court of domicile of Kilpissafarit.
12. Snowmobiles are insured. In case of accidents or negligence liability for damages 1500 euros, which is charged immediately after rental period.
Rental Equipment

1. The renter must provide verification of his identity. At the time of rent Kilpissafarit may ask for credit card details as a guarantee.
2. Rented items may not be new and there might be some marks and dents of use. The renter must verify the condition of the equipment before use. Marks and dents can be written down to this contract. Kilpissafarit recommends taking photos of equipment before rental.
3. The renter agrees to comply with the Finnish law, regulations and good manners. The renter also pledges to use the equipment only in the manner intended. Use of the equipment under of the influence of alcohol or drugs is prohibited.
4. The renter is not allowed to turn over the equipment to a third party, unless agreed otherwise.
5. Taking the rented equipment outside the Finnish border is prohibited unless agreed otherwise.
6. The renter is committed to take good care of the equipment. The renter is responsible for the rented equipment for the full purchase price until it has been returned to Kilpissafarit. In case of an accident the renter is responsible to inform Kilpissafarit immediately about accident or any damages to the rented items. The renter is under obligation to compensate for the damage caused to the equipment, return the equipment back to rental and inform the damages to the staff. In case of rental bicycle gets flat tire, driving must stop immediately and inform Kilpissafarit. Renter needs to walk bicycle carefully to main road in 10 km radius from Kilpissafarit. Fixing for example flat tire costs 60 € for renter including car transportation of damaged bicycle from max 10 km radius to Kilpissafarit.
7. If a technical fault or other similar issues arise with the equipment during the rent period and the Kilpissafarit either repairs the equipment or delivers a replacement with a reasonable time, there is no refund for the rent or the loss of rental period.
8. The renter is also responsible for any damage caused to a third party. Kilpissafarit is not responsible for any losses caused to renter in case of breakdown of rented item.
9. The rented equipment must be returned to the agreed location by the agreed time. If the renter does not return the equipment by the agreed time the owner has the right to charge double fee for the extra time as well as charge any costs caused by the neglect.
10. Kilpissafarit reserves the right to terminate this contract before the end of the rent period if it comes to light the renter does not follow the terms of the agreement. In this case there is to be no refund for the rent or the loss of rental period.
11. Disagreements are to be resolved primarily by negotiation. If the disagreements are taken to court the lawsuit must be brought to the district court of the area the rental company is located at.
